These Terms and Conditions outline, state and govern the business relationship between the users (hereinafter referred to as “you”) of the following website: https://www.hardershawaii.com/ and the company operating the aforementioned website, which is: Island Maid Inc, a company with registered office location at 94-125 Leokane St. Waipahu, HI 96797 (hereinafter referred to as “we”, “our”, “Island Maid”, “Harders Hawaii” etc). Anyone who accesses, browses, visits, purchases something from our website/online store is considered a user under these Terms and Conditions and such user will be deemed to have accepted these Terms and Conditions by browsing, visiting, accessing and/or purchasing something from our website/online store. If you do not wish to comply, adhere to or you do not agree to these Terms and Conditions, please do not use, browse or submit an order from our website/online store.
HARDERS PRODUCTS AS AIRPLANE LUGGAGE
We do not recommend or approve taking our gallon syrups, extracts, colors, or portion cup juices/water with you on a plane as check-in or carry-on luggage. If you choose to transport products on your own, you must provide your own packaging material (i.e. boxes, padding) to ensure the products' safety. Island Maid / Harders Hawaii will not accept responsibility for any damages caused during commercial passenger airline transport as check-in or carry-on luggage. We do offer competitive shipping rates if you do wish to ship your gallons to the mainland or outer islands. To place an order, please click here.
COMMUNICATION WITH CUSTOMERS
We strive to provide the best and most efficient customer service possible. Due to limited staff, we will prioritize emailing customers for any follow-ups or order issues, rather than over-the-phone calling. We feel this is the best way to ensure issues are resolved in a timely and efficient manner while minimizing chances for miscommunication. Additionally, we kindly request that customers ensure their email addresses are kept up to date to facilitate seamless communication with our team. Maintaining a working, accurate, and current email address on file will enable us to promptly address any concerns, provide updates on orders, and efficiently assist with any inquiries.
ORDERING AND SHIPPING
All orders will ship within 5-7 business days from the date of payment, unless otherwise specified on Island Maid's website. Orders are shipped via UPS, FedEx, or USPS. Island Maid reserves the right to choose the shipping carrier to ship your product. Requesting a specific shipping carrier to ship your order may require additional fees. Although this is a rare occurrence, depending on the size of your order and or demand for a certain item, your order may be delayed. Please make sure that you provide us with your correct shipping address before placing an order. We cannot guarantee any store credit or refunds if the address provided is incorrect. Please note that orders are shipped and delivered on business days only (This excludes weekends and holidays). Typically, three delivery attempts will be made before the package is returned to us. Penalties and fees may be applied. To avoid this inconvenience, we recommend delivery to a commercially zoned business address. We cannot ship to PO, FPO, APO or IPO boxes. We cannot ship internationally. Orders not placed through our online store may not be eligible for discounted shipping rates.
You hereby agree that we cannot be liable for not delivering your order on time due to any event, circumstance or occurrence that was beyond our reasonable control such as adverse weather events, among other things.
ISLAND MAID RETURN AND REFUND POLICY (UPDATED! 03/07/2023)
As of 03/07/2023 all full and partial refunds will be subject to a 4% fee. The reason for implementing a 4% fee for customer refunds to better reflect the fact that Island Maid Inc. does not receive the full processing fees from our credit card payments partners when refunds occur, which is in line with the current industry standards.
We are unable to accept any returns at the moment for health and safety reasons. Island Maid / Harders Hawaii reserves the right to handle each return or refund case at its own discretion. Please report any received Island Maid products that are damaged (i.e. leaking gallon bottles) due to mishandling by the shipper or any mistakes in your order. Please have the invoice number and tracking number associated with the order and information on the exact quantity and type of product damaged. Please include any pictures or files that can help us better file your claim with the shipper. If a damage claim is not honored by the shipping company, we will not be able to reship your damaged or missing items. In this case, a store credit or refund will be offered as compensation. If you are ordering more than 30 gallons, we would highly recommend shipping via ocean freight as your order will have a higher chance of arriving without damages. We cannot guarantee any credits or refunds for any gallon orders that arrive damaged when shipped via USPS, UPS, or FedEx for orders above 30 gallons. Please contact us to learn more about ocean freight. For products that are missing due to complete damage during shipping, we will handle each case at our own discretion. If you would like to file a damage claim with the shipper, please make sure to include pictures of the damaged product and packaging to ensure the best chances of a successful claim. Island Maid is not responsible for any damaged or lost orders that are sent via third party shippers inside or outside of the United States of America.
PRODUCT LEAKING DURING SHIPPING
Our gallons are designed to deal with the extreme fluctuations in air pressure during air freight. This means that, occasionally, some syrup will leak out to prevent overpressure in the bottle. This is unfortunately normal. No replacement will be issued, instead if the syrup loss is more than 2 ounces, we will issue a store credit equal to the amount of syrup loss. If a significant amount of syrup is loss (more than half a gallon) please take as many clear pictures of the damaged bottle, the bottle side with a view of the original seal still on, and packaging as possible and contact us. Island Maid reserves the right to handle each incident at its own discretion.
PO BOX ADDRESSES
Shipping to PO Box addresses is only available for single 25oz 4pack orders that can fit in a USPS box. Gallon syrup orders that are shipped to a PO Box will require an additional postage fee after the order is placed. Please enter valid and truthful street addresses.
INTELLECTUAL PROPERTY
We are the owner and/or authorized user of all trademarks, service marks, patents, recipes, copyrights, database rights and all other intellectual property appearing on or contained within the Site, unless otherwise indicated. Except as provided in these Terms & Conditions, use of the Site does not grant you any right, title, interest or license to any such intellectual property you may access on the Site. Except as provided in these Terms & Conditions, any use or reproduction of the intellectual property is prohibited. Such rights will be protected under the copyright and other intellectual property laws of the United States of America (USA) and other worldwide laws.
NO LIABILITY
To the fullest extent permitted by law we, our officers, directors, employees, agents and assigns, hereby disclaim all liability for any loss, cost or damage (direct, indirect, consequential ,or otherwise) suffered by you as a result of your use of the site or from any computer virus transmitted through the site, or other sites accessed from this site, whether such loss, cost or damage arises from our negligence or otherwise and even if we are expressly informed of the possibility of such loss or damage.

AMENDMENTS AND MODIFICATIONS
Island Maid / Harders Hawaii Terms and conditions are subject to change without notice. You are responsible for regularly checking these Terms and Conditions for amendments and modifications. Using our services, website/online store and/or purchasing/making orders for products/items on our website after any modifications to these Terms and Conditions have been posted denotes acceptance of such amendments and modifications.
12 GALLON PACK EXPEDITED SERVICE
This expedited order processing and shipping upgrade is exclusively available for the Harders 12-gallon pack. Please note that a supplementary service fee of $120 shall be applied, in addition to the cost of syrups. This added charge is intended to cover the costs incurred for expedited shipping and priority order processing. This expedited service entails an order processing time of one day. Orders placed after 12 PM will be processed the following day, with an automatic upgrade to two-day shipping. Be advised that shipping times are contingent upon the service conditions of the shipping carrier and, as such, cannot be guaranteed.
